If your AI strategy assumes privacy regulation is a "future problem," your timeline just got a reality check. The Privacy and Other Legislation Amendment Act 2024 (Cth) has set 10 December 2026 as the commencement date for new transparency obligations regarding automated decisions.
For APP entities, this is a significant shift in privacy-policy requirements. While the legal change is framed as transparency, the operational consequence is governance: you cannot accurately disclose what you have not mapped. Crucially, this 2026 date is specifically for the new disclosure layer; many other privacy obligations regarding AI and personal information already apply now.

1. The "It’s Not AI" Illusion
These rules are technology-neutral. The statutory trigger is not "AI," but any computer program used to make, or do something substantially and directly related to making, a decision. This likely captures legacy rules engines, scoring tools, and fraud logic that have been running for years. If the software is used in a decision that could reasonably be expected to significantly affect an individual’s rights or interests, it is likely in scope.
2. The "Human in the Loop" Safety Net
A human sign-off does not automatically take a workflow out of scope. There is no "magic exemption" for having a person in the loop if the software performs a function substantially and directly related to a significant decision, such as ranking, scoring, or triaging. While meaningful human review matters for risk, the relevant kinds of decisions may still need to be described in your privacy policy.
3. The HR Recruitment Blindspot
Recruitment is a sharper privacy risk area than many assume. The OAIC has clarified that the employee records exemption does not cover future employment relationships, meaning unsuccessful applicants are not exempt. Automated CV screening and candidate ranking tools are genuine blindspots that require mapping well before the 2026 deadline.
4. The Inferred Data Trap
Your disclosure obligations cover the kinds of personal information used in qualifying programs. This includes more than just raw inputs. Inferred, incorrect, or artificially generated information, such as risk scores, rankings, or profile attributes, can be personal information if it relates to an identified or reasonably identifiable individual. If your system uses this inferred data to make significant decisions, your policy must reflect it.
5. Sovereignty vs. Residency
Do not confuse Australian data residency with Privacy Act compliance. The live issues are who can access the information, whether the handling is a use or a disclosure, and whether effective control is retained. For example, entering personal information into a public AI chatbot can amount to a disclosure to the vendor, triggering complex overseas-recipient obligations that exist today.
